Divorce with foreigners residing in Vietnam

Foreigners residing in Vietnam should check jurisdiction, documents and participation requirements before choosing consensual or unilateral divorce proceedings.

Living in Vietnam does not remove the international issues

A foreign spouse’s presence in Vietnam may make document collection and communication more practical, but it does not eliminate the need to assess jurisdiction and the appropriate divorce route. Nationality, residence, the marriage record and any children or assets abroad remain relevant.

A residence card, employment arrangement or rental agreement may help explain the facts. It should not be treated as an automatic entitlement to divorce before a particular court.

Choose consensual or unilateral proceedings

The consensual route depends on voluntary agreement and suitable arrangements concerning children and relevant property matters. If a spouse does not agree, will not sign or disputes important claims, a unilateral request may need assessment under the legal grounds and evidence available.

Even when both parties live in Vietnam, work schedules, interpretation needs or travel plans can affect participation. Explain these practical issues early rather than assuming a lawyer may replace a spouse throughout the personal divorce process.

Check the current court and prepare consistent records

Since 1 July 2025, the allocation of first-instance marriage and family cases must be checked under the reformed court structure. Regional People’s Courts deal with these cases within their statutory jurisdiction. A foreign connection does not by itself identify the correct territorial court; nationality, residence, the nature of the request and relevant assets still require review.

Where the marriage was registered abroad, distinguish the existence and recognition of that marriage from the separate question of recording it in Vietnam. A document review should establish the correct civil-status and evidential steps for the case, rather than assuming that a new marriage registration is always required.

• Marriage certificate and any relevant civil-status extracts.
• Passports or identity documents and reliable residence information for both spouses.
• A petition or joint request stating the relief sought.
• Children’s records, parenting proposals, support evidence and any relevant prior orders.
• Asset, debt and foreign-document records where those matters form part of the request.

Confirm the available filing and payment channels

Electronic filing facilities must be checked with the competent court and applicable procedure. Do not assume that every court accepts a full divorce dossier through a national portal, that every fee can be paid by e-wallet or that scanning documents removes the need for originals.

Follow the receiving court’s instructions on submission, fee advances, supplementation and attendance. If interpretation is needed, plan for the required interpreter and translated documents in time.

Prepare for related cross-border consequences

Consider whether the Vietnamese outcome will need to be used in another country for civil status, parenting, property or residence purposes. Recognition and enforcement abroad depend on that jurisdiction’s requirements and should be reviewed separately from the Vietnamese filing.
