1. Definition of Emotional Abuse in Marriage

According to the Law on Domestic Violence Prevention and Control 2022, domestic violence includes more than physical assault or conduct causing bodily injury. Domestic violence also includes acts that insult dignity or personal honor, isolate a family member, impose psychological control, issue threats, use verbal humiliation, or create continuous psychological pressure toward a family member.

Common manifestations of emotional abuse include:

  • Frequent verbal insults, humiliation, or conduct that damages dignity
  • Control over finances or social relationships
  • Threats that cause fear or psychological distress
  • Isolation from family members or friends
  • Public extramarital relationships accompanied by serious humiliation toward the other spouse
  • Long-term psychological pressure that causes emotional collapse

Emotional abuse may not cause visible physical injury. However, such conduct may lead to serious consequences, including depression, anxiety disorders, loss of working capacity, or negative psychological effects on children.

2. Emotional Abuse as Legal Grounds for Divorce

The answer is YES.

According to Article 56 of the Law on Marriage and Family 2014, the court may grant divorce upon request from one spouse (unilateral divorce) when one of the following conditions exists:

  • Conduct involving domestic violence, or
  • Serious violation of marital rights and obligations that causes the marriage to fall into a serious condition, prevents continuation of shared life, and causes failure of marital purposes

Emotional abuse qualifies as a form of domestic violence. When such conduct occurs in a serious and prolonged manner and results in actual harm, emotional abuse may constitute legal grounds for court approval of a unilateral divorce request.

However, the requesting party must provide evidence of emotional abuse through documents such as:

  • Messages, audio recordings, or video recordings
  • Psychological or medical records
  • Testimony from witnesses

3. Actions to Take When Experiencing Emotional Abuse and Seeking Divorce

When emotional abuse occurs and divorce becomes necessary, several steps may be considered.

Step 1: Collect and preserve evidence
All relevant materials demonstrating emotional abuse should be collected and stored carefully.

Step 2: Request intervention when necessary
A report may be submitted to local police authorities or the People Committee at the commune or ward level. Emergency protection measures may also be requested in accordance with legal provisions.

Step 3: Submit a unilateral divorce petition

Required documents may include:

  • Divorce petition
  • Marriage certificate
  • Birth certificate of children, when applicable
  • Documents demonstrating emotional abuse
