A missing person is an individual who no longer appears at the last registered residence and has no verified information for a prolonged period, causing legitimate concern. Causes of disappearance may vary, including abduction, accidents, or voluntary absence.

A person is officially considered missing only after a court decision declaring the individual missing. This decision serves as a legal basis for subsequent civil procedures.

2. Legal Regulations on Missing Persons

An individual is considered missing when no verified information is available for a consecutive period of two years or more, despite full implementation of legal procedures for public notification and search under civil procedure regulations. Upon request from an entitled party, a court may declare the individual missing.

The two-year period is calculated from the date of the last verified information. If the exact date cannot be determined, calculation follows the first day of the month after the last known month. If neither date nor month is identifiable, calculation follows the first day of the subsequent year.

If one spouse is declared missing and the other spouse requests divorce, the court will settle the case under the Law on Marriage and Family 2014.

The court decision declaring an individual missing must be forwarded to the commune-level People Administration Committee at the last residence for registration under civil status regulations.

“2. When the spouse of a person who is declared missing by a court requests a divorce, the court shall permit the divorce.”

The court will initiate proceedings in accordance with unilateral divorce procedures.

Therefore, divorce is permitted only when a court decision declaring missing status has been issued. Other factors cannot serve as a legal basis.
