1. What Is Joint Debt of Spouses?

Joint debt refers to financial obligations arising during the marriage period for the purpose of serving the common interests of the family.

Debts commonly regarded as joint debt include:

  • Loans used for daily household expenses
  • Loans for purchasing housing, vehicles, or renovating shared residential property
  • Debts serving joint business activities
  • Loans jointly entered into by both parties
  • Loans entered into by one party with awareness, consent, or shared benefit of the other party
  • Other related financial obligations

Such debts shall be reviewed and resolved by the Court during divorce proceedings.

2. What Debts Are Considered Separate Debt Upon Divorce?

Not all debts arising during marriage are classified as joint debt. Separate debt generally includes:

  • Debts arising before marriage
  • Debts incurred during marriage for personal purposes
  • Debts unilaterally incurred by one party without knowledge or benefit of the other party
  • Debts arising from unlawful conduct such as gambling or illegal betting

For separate debt, the borrowing party bears independent responsibility, and the remaining party is not required to share repayment obligations.

3. Principles for Division of Joint Debt Upon Divorce

According to Article 27 of the Law on Marriage and Family 2014 regarding joint liability of spouses:

  1. Spouses bear joint liability for transactions conducted by one party as stipulated in Clause 1 Article 30 or other transactions in accordance with representative provisions under Articles 24, 25, and 26 of this Law.
  2. Spouses bear joint liability for obligations stipulated under Article 37 of this Law.

Pursuant to Article 37 of the same Law, joint property obligations include:

  1. Obligations arising from transactions jointly agreed upon by spouses, including compensation obligations jointly borne under legal regulations
  2. Obligations performed by either party to meet essential family needs
  3. Obligations arising from possession, use, or disposition of common property
  4. Obligations arising from use of separate property to maintain or develop common property or to generate primary income for the family
  5. Compensation obligations arising from damage caused by children, where parents are required to provide compensation under the Civil Code
  6. Other obligations as prescribed by relevant laws

In addition, Article 60 of the Law on Marriage and Family 2014 regulates the settlement of property rights and obligations toward third parties after divorce, as follows:

  1. Property rights and obligations of spouses toward third parties remain effective after divorce, except in cases where spouses and third parties reach a separate agreement.
  2. In case of disputes related to property rights and obligations, provisions under Articles 27, 37, and 45 of this Law and relevant provisions of the Civil Code shall apply.

Based on these legal grounds, joint debt of spouses is determined as a shared obligation. Therefore, even after divorce, both parties remain equally responsible for debt repayment.
However, where spouses and a third party reach a different agreement, joint debt shall be resolved in accordance with such agreement.

4. Who Bears the Burden of Proof for Joint Debt or Separate Debt?

In dispute resolution:

  • A party claiming joint debt must prove that the loan served a common purpose and provided shared benefits
  • A party claiming separate debt must prove lack of awareness, lack of consent, and absence of benefit
