1. Definition of Common Marital Property

Under the Law on Marriage and Family, common marital property refers to property jointly created during the period of marriage. Article 33 of this Law provides as follows:

“1. Common marital property includes property created by both spouses, income derived from labor, production and business activities, yields and profits arising from separate property, and other lawful income generated during the period of marriage, except for cases prescribed in Clause 1 Article 40 of this Law; property inherited jointly or given jointly by donation; and other property agreed by both spouses to be classified as common property.

Land use rights acquired after marriage constitute common marital property, except in cases of separate inheritance, separate donation, or acquisition through transactions funded by separate property.

2. Common marital property is subject to unified joint ownership and is used to satisfy family needs and to perform common obligations during marriage.

3. In the absence of evidence proving that disputed property constitutes separate property of either party, such property shall be deemed common marital property.”

These provisions form the legal basis for determining common marital property. With respect to other lawful income and yields or profits arising from separate property, detailed guidance is provided under Article 9 and Article 10 of Decree No. 126/2014/ND-CP.

2. Definition of Common Marital Property Dissipation During Divorce

Common marital property dissipation during divorce refers to intentional acts by one party to transfer, conceal, or reduce the value of common marital property for the purpose of avoiding property division when the Court resolves the divorce.

Such conduct may occur:

  • Prior to submission of a divorce petition
  • During the period in which the Court is handling the divorce case

Common forms and indicators of property dissipation include:

  • Transfer of property to relatives under nominee arrangements
  • Withdrawal or transfer of all funds from bank accounts
  • Sale of common marital property at an abnormally low price
  • Creation of fictitious loan agreements to conceal assets
  • Failure to declare or incomplete declaration of common marital property
