Foreign residents should distinguish the conditions for entering a valid marriage from the requirements for ending it. Residence, nationality and foreign civil-status records can affect the relevant procedures, and a ceremony alone does not answer every legal question.
Marriage conditions and legal registration
A foreign person planning marriage in Vietnam should review the conditions applicable to both parties. Under Vietnamese family law, marriage must be voluntary and the parties must satisfy the legal age and other conditions, including the absence of a prohibited existing marital relationship.
A wedding celebration and legal marriage registration are different. A ceremony alone does not replace the registration needed to establish the legal marriage under the applicable procedure. The competent registration authority and present requirements should be confirmed before the couple gathers the file.

Documents issued in another country
Foreign identity and civil-status records should be checked for consistency, intended use, authenticity and translation. Determine which documents are required in the actual circumstances and which issuing authority can provide a suitable record.
For foreign public documents, examine the applicable treaty route or exemption rather than assuming that every record requires consular legalisation. The Apostille Convention entered into force for Viet Nam on 11 September 2026, but the countries, any objections and the document's scope must be checked.
How divorce differs from marriage registration

A later divorce requires a separate jurisdiction and procedural assessment. A consensual divorce depends on genuine agreement and appropriate family arrangements. A unilateral case requires the statutory grounds and evidence. There is no general rule that twelve months of abandonment or twenty-four months of separation automatically establishes a Vietnamese divorce entitlement.
Where a spouse lives abroad, obtaining reliable address information and planning procedural notice are important. The current court structure and territorial competence must be checked under the amended Civil Procedure Code.
Children and financial consequences
Parents should consider direct care, support and continuing relationships in light of the child's interests. A child's nationality does not remove the need to assess jurisdiction and the practical care arrangements. Any move between countries deserves separate consideration.
Property acquired in Vietnam or abroad may require distinct evidence and legal analysis. A Vietnamese divorce decision and recognition or implementation in another country are different matters; obtaining one should not be assumed to complete the other automatically.
