Understanding the procedural route helps international clients prepare a coherent divorce request. A joint application and a contested petition require different foundations, while both call for reliable marriage records and attention to children, property and participation requirements.
Two procedural starting points
Vietnamese family law distinguishes a genuine joint divorce request from divorce sought by one spouse under the statutory grounds. The distinction affects the application, the evidence and the issues the court must examine. It should reflect the spouses' actual positions rather than the title placed on a form.
In a consensual case, both spouses' wishes and the relevant arrangements for children and property need to be clear. The court must assess whether the agreement protects the legitimate family interests required by law. A private agreement does not itself terminate the marriage.

What a contested petition needs to explain
A unilateral petition should state the facts supporting the grounds for divorce and identify the orders requested. Allegations of violence or serious breaches of marital obligations should be supported by lawful evidence. The court determines whether the statutory conditions are established.
Disputed children, support or assets require separate attention. The petition should not assume that blame for the marital breakdown automatically decides custody or transfers all property to the applicant.
Jurisdiction and preparation

Current court competence must be assessed under the amended Civil Procedure Code, including the regional court structure introduced from July 2025. International jurisdiction and territorial connections remain important where a spouse is a foreign national or lives abroad.
- Identify the marriage record and each party's current identity and residence information.
- Prepare a reliable chronology of relevant events.
- Organise records supporting any parenting, property or debt request.
- Confirm the other spouse's location and the information needed for procedural notice.
Participation and the lawyer's support
A lawyer can explain the procedural options, draft the request and help organise evidence. The scope of assistance should distinguish the work the lawyer can perform from the personal participation that remains necessary for the spouse. Representation by authorisation is restricted in the divorce itself.
For an overseas client, requests relating to absence and the handling of foreign documents should be planned before filing. Permission to proceed without attendance depends on the applicable procedure and the court's assessment; it is not an automatic benefit of engaging a legal service.
