1. Definition of Change of Direct Child Custody

A change of direct child custody refers to a legal procedure in which an individual (father or mother) or a competent authority or organization submits a request to a court for re-examination and issuance of a new decision regarding the person who directly supervises, cares for, nurtures, and educates a child after a divorce judgment or decision of a court has taken legal effect.

This change aims to ensure that a child is provided with the most comprehensive environment for development in both material and spiritual aspects in cases where the current custodial person no longer satisfies sufficient capacity or conditions to properly perform legal obligations.

2. Conditions for Change of Direct Child Custody under Law

Pursuant to Article 84 of the Law on Marriage and Family 2014, a court shall consider a change of direct child custody when one of the following grounds exists:

  • Agreement between father and mother: This is the most favorable condition. In cases where father and mother reach a voluntary agreement on transfer of custody based on the best interests of a child, a court shall recognize such an agreement.
  • Current custodial person no longer satisfies required conditions: In cases where the current custodial person fails to ensure proper supervision, care, nurturing, and education of a child (for example: financial deterioration, involvement in social evils, frequent neglect, or acts of violence), the other party has the right to request a change.

Moreover, the wishes of a child of 07 years of age or older constitute one of the key factors. In such cases, a court is required to consider the wishes of a child regarding preferred living arrangements.

3. Important Notes during Implementation of Procedures

To successfully request a change of direct child custody, the requesting party must prepare persuasive evidence to demonstrate better conditions compared to the other party:

  • Financial evidence: Stable income, lawful residence, and a healthy living environment. Supporting documents may include salary statements for the most recent 06 months; a certificate of land use rights, ownership of residential housing, and other assets attached to land to demonstrate availability of accommodation for a child; or an apartment lease agreement.
  • Time availability: Ability to spend time with a child, including daily care, transportation, and education.
  • Moral qualifications: A custodial person must maintain a healthy lifestyle, comply with law, and avoid conduct that may negatively affect the psychological development of a child.

In cases where both father and mother are deemed not to satisfy conditions for direct child custody, a court shall assign custody to a guardian in accordance with provisions of the Civil Code.
