1. What is divorce registration?

Divorce registration (also known as registering a divorce conducted abroad) is an administrative procedure aimed at updating the marital status of Vietnamese citizens or foreigners in the Vietnamese civil registry database after a divorce has been granted by a competent authority in a foreign country.

According to Clause 2, Article 37 of Decree 123/2015/ND-CP, the regulations on recording divorce and annulment in the civil registry are as follows:

"1. A divorce judgment, annulment decision, divorce agreement, or other document recognizing the divorce issued by a competent foreign authority (hereinafter referred to as divorce documents) that does not violate the provisions of the Law on Marriage and Family shall be recorded in the Civil Registry.

2. Vietnamese citizens who have divorced or annulled their marriage abroad, and subsequently return to Vietnam to reside permanently or register a new marriage at a competent Vietnamese authority, must have the divorce or annulment resolved abroad recorded in the Civil Registry (hereinafter referred to as divorce annotation). In cases of multiple divorces or annulments, only the most recent divorce annotation shall be made.

3. Based on officially received information, the Ministry of Justice shall publish it on its electronic portal. The Ministry of Justice list of divorce and annulment judgments and decisions of Vietnamese citizens resolved by competent foreign authorities, which fall under the cases where an enforcement request is filed in Vietnam or a request for non-recognition is filed in Vietnam."

In other words, the divorce annotation is essentially a "notification" to the Vietnamese government that: "I have divorced abroad, and I want to update my records in my home country."

2. Why is divorce registration necessary?

Many people carelessly skip this step, leading to serious legal consequences:

  • Inability to remarry: You will be denied a Certificate of Marital Status (confirming single status) because you are still listed as married in the system.
  • Risk of property disputes: Assets you purchased abroad after the divorce (but not registered in Vietnam) may be considered joint property, leading to unnecessary disputes.
  • Complications when registering your child birth: If you have a child with a new partner, registering the birth and determining parent-child relationships will be extremely complicated.

3. The latest divorce registration procedure in 2026
According to current regulations, this process has been significantly optimized through the VNeID system and the Public Service Portal.

Documents required:

  • Foreign divorce judgment/decision: Legalized by consular authorities and notarized translation into Vietnamese.
  • Personal identification documents: Citizen Identification Card or Passport (certified copy).
  • Proof of residence documents: To determine jurisdiction.

Where to submit the application:

  • Commune People Committee: Where you are registered as a permanent resident in Vietnam.
  • Online via the Dichvucong portal.

Processing time:
Typically 5 to 8 working days from the date of receipt of complete and valid documents.
